Orangedox for Dropbox Terms of Service

Thanks for using Orangedox for Dropbox! These terms of service ("Terms") cover your use and access to the services and websites ("Services") provided by Orangedox for Dropbox a Crystalline Technologies Inc company ("Orangedox for Dropbox"). Our Privacy Policy explains how we collect and use your information while our Acceptable Use Policy outlines your responsibilities when using our Services. By using our Services, you're agreeing to be bound by these Terms, and to review our Privacy and Acceptable Use policies. If you're using our Services for an organization, you're agreeing to these Terms on behalf of that organization.

Your Dropbox Stuff & Your Permissions

When you use our Services, you provide us with a list of your Dropbox Stuff ("Your Dropbox Stuff"). Your Dropbox Stuff is yours. These Terms don't give us any rights to Your Dropbox Stuff except for the limited rights that enable us to offer the Services.

We need your permission to host share links to Your Dropbox Stuff when you ask us to. These and other features may require our systems to access meta data (data related, but not included within your files) around Your Dropbox Stuff. You give us permission to do those things, and this permission extends to trusted third parties we work with.

Sharing Your Dropbox Stuff

Our Services let you share Your Dropbox Stuff with others, so please think carefully about what you share.

Your Responsibilities

You're responsible for your conduct, Your Dropbox Stuff that is shared using our Services must comply with our Acceptable Use Policy.

We may review your conduct and content for compliance with these Terms and our Acceptable Use Policy. With that said, we have no obligation to do so. We aren't responsible for the content people post and share via the Services.

Finally, our Services are not intended for and may not be used by people under the age of 13. By using our Services, you are representing to us that you're over 13.

Our Stuff

The Services are protected by copyright, trademark, and other Canadian and foreign laws. These Terms don't grant you any right, title or interest in the Services, others' content in the Services, Orangedox for Dropbox trademarks, logos and other brand features. We welcome feedback, but note that we may use comments or suggestions without any obligation to you.

Paid Accounts

Billing. You can increase your number of share links and add paid features to your account (turning your account into a "Paid Account"). We'll automatically bill you from the date you convert to a Paid Account and on each periodic renewal until cancellation. You're responsible for all applicable taxes, and we'll charge tax when required to do so.

No Refunds. You may cancel your Orangedox for Dropbox Paid Account at any time but you won't be issued a refund.

Downgrades. Your Paid Account will remain in effect until it's cancelled or terminated under these Terms. If you don't pay for your Paid Account on time, we reserve the right to suspend it or reduce your share links to free space levels.

Changes. We may change the fees in effect but will give you advance notice of these changes via a message to the email address associated with your account.

Termination

You're free to stop using our Services at any time. We also reserve the right to suspend or end the Services at any time at our discretion and without notice. For example, we may suspend or terminate your use of the Services if you're not complying with these Terms, or use the Services in a manner that would cause us legal liability, disrupt the Services or disrupt others' use of the Services. Except for Paid Accounts, we reserve the right to terminate and delete your account if you haven't accessed our Services for 12 consecutive months. We'll of course provide you with notice via the email address associated with your account before we do so.

Services "AS IS"

We strive to provide great Services, but there are certain things that we can't guarantee. TO THE FULLEST EXTENT PERMITTED BY LAW, ORANGEDOX FOR DROPBOX AND ITS AFFILIATES, SUPPLIERS AND DISTRIBUTORS MAKE NO WARRANTIES, EITHER EXPRESS OR IMPLIED, ABOUT THE SERVICES. THE SERVICES ARE PROVIDED "AS IS." WE ALSO DISCLAIM ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL ORANGDOX FOR DROPBOX, ITS AFFILIATES, SUPPLIERS OR DISTRIBUTORS BE LIABLE FOR (A) ANY INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, EXEMPLARY OR CONSEQUENTIAL DAMAGES OR ANY LOSS OF USE, DATA, BUSINESS, OR PROFITS, REGARDLESS OF LEGAL THEORY, WHETHER OR NOT ORANGEDOX FOR DROPBOX HAS BEEN WARNED OF THE POSSIBILITY OF SUCH DAMAGES, AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE; (B) AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES MORE THAN THE GREATER OF $20 OR THE AMOUNTS PAID BY YOU TO ORANGEDOX FOR DROPBOX FOR THE PAST 12 MONTHS OF THE SERVICES IN QUESTION.

Resolving Disputes

Let's Try To Sort Things Out First. We want to address your concerns without needing a formal legal case. Before filing a claim against Orangedox for Dropbox, you agree to try to resolve the dispute informally by contacting contact@orangedox.com. We'll try to resolve the dispute informally by contacting you via email. If a dispute is not resolved within 15 days of submission, you or Orangedox for Dropbox may bring a formal proceeding.

Controlling Law

These Terms will be governed by British Columbia of Canada law except for its conflicts of laws principles.

Entire Agreement

These Terms constitute the entire agreement between you and Orangeodx for Dropbox with respect to the subject matter of these Terms, and supersede and replace any other prior or contemporaneous agreements, or terms and conditions applicable to the subject matter of these Terms. These Terms create no third party beneficiary rights.

Waiver, Severability & Assignment

Orangedox for Dropbox's failure to enforce a provision is not a waiver of its right to do so later. If a provision is found unenforceable, the remaining provisions of the Terms will remain in full effect and an enforceable term will be substituted reflecting our intent as closely as possible. You may not assign any of your rights under these Terms, and any such attempt will be void. Orangedox for Dropbox may assign its rights to any of its affiliates or subsidiaries, or to any successor in interest of any business associated with the Services.

Modifications

We may revise these Terms from time to time, and will always post the most current version on our website. If a revision meaningfully reduces your rights, we will notify you (by, for example, sending a message to the email address associated with your account, posting on our blog or on this page). By continuing to use or access the Services after the revisions come into effect, you agree to be bound by the revised Terms.

Orangedox for Dropbox Privacy Policy

This Privacy Policy provides our policies and procedures for collecting, using, and disclosing your information. This Privacy Policy governs your access of the Orangedox for Dropbox Service, regardless of how you access it, and by using our Services you consent to the collection, transfer, processing, storage, disclosure and other uses described in this Privacy Policy. All of the different forms of data, content, and information described below are collectively referred to as "information."

1. The Information We Collect and Store

We may collect and store the following information when running the Orangedox for Dropbox Service:

Information Provided when Registering using Dropbox

When you register an account on Orangedox for Dropbox using Dropbox, we collect the following information from your Dropbox account: your Dropbox account number, name, country and email.

Dropbox Files

With the exeption of PDF previewing with out Business plan, at no time do we access, modify or create files found on your Dropbox account. Meta data (data related, but not included within your files) on your Dropbox files may be used when creating Share Links (see Share Links below). PDF files (file with extension .pdf for our Business Plan ONLY) will be access and converted for use in our HTML viewer and finally stored using 256 bit encryption on our servers hosted by Amazon.

Share Links

When creating a new share link using the Service, the following information is collected: the path to the file within your Dropbox account, the share link URL to the file on Dropbox.

Cookies

We also use "cookies" to collect information and improve our Services. A cookie is a small data file that we transfer to your Device. We may use "persistent cookies" to save your registration ID and login password for future logins to the Service. We may use "session ID cookies" to enable certain features of the Service, to better understand how you interact with the Service and to monitor aggregate usage and web traffic routing on the Service. You can instruct your browser, by changing its options, to stop accepting cookies or to prompt you before accepting a cookie from the websites you visit. If you do not accept cookies, however, you may not be able to use all aspects of the Service.

2. How We Use Personal Information

Personal Information.

In the course of using the Service, we may collect personal information that can be used to contact or identify you ("Personal Information"). Personal Information is or may be used: (i) to provide and improve our Service, (ii) to administer your use of the Service, (iii) to better understand your needs and interests, (iv) to personalize and improve your experience, and (v) to provide or offer software updates and product announcements.

Analytics

We also collect some information (ourselves or using third party services) using logging and cookies, such as IP address, which can sometimes be correlated with Personal Information. We use this information for the above purposes and to monitor and analyze use of the Service, for the Service's technical administration, to increase our Service's functionality and user-friendliness, and to verify users have the authorization needed for the Service to process their requests.

3. Information Sharing and Disclosure

Service Providers, Business Partners and Others.

We may use certain trusted third party companies and individuals to help us provide, analyze, and improve the Service (including but not limited to data storage, maintenance services, database management, web analytics, and improvement of the Service's features). These third parties may have access to your information only for purposes of performing these tasks on our behalf and under obligations similar to those in this Privacy Policy

Compliance with Laws and Law Enforcement Requests; Protection of Orangedox for Dropbox's Rights.

We may disclose to parties outside Orangedox for Dropbox information about you that we collect when we have a good faith belief that disclosure is reasonably necessary to (a) comply with a law, regulation or compulsory legal request; (b) protect the safety of any person from death or serious bodily injury; (c) prevent fraud or abuse of Orangedox for Dropbox or its users.

Non-private or Non-Personal Information.

We may disclose your non-private, aggregated, or otherwise non-personal information, such as usage statistics of our Service.

We will retain your information for as long as your account is active or as needed to provide you services.

6. Changes to our Privacy Policy

This Privacy Policy may change from time to time. If we make a change to this privacy policy that we believe materially reduces your rights, we will provide you with notice (for example, by email). And we may provide notice of changes in other circumstances as well. By continuing to use the Service after those changes become effective, you agree to be bound by the revised Privacy Policy.

Orangedox for Dropbox Acceptable Use Policy

You agree not to misuse the Orangedox for Dropbox services ("Services"). For example, you must not, and must not attempt to do the following:

  • probe, scan, or test the vulnerability of any system or network;
  • breach or otherwise circumvent any security or authentication measures;
  • access, tamper with, or use non-public areas or parts of the Services, or shared areas of the Services you haven't been invited to;
  • interfere with or disrupt any user, host, or network, for example by sending a virus, overloading, flooding, spamming, or mail-bombing any part of the Services this includes, but is not limited to, the creation of share links outside our supported interface;
  • access or search the Services by any means other than our publicly supported interfaces (for example, "scraping");
  • send unsolicited communications, promotions or advertisements, or spam;
  • send altered, deceptive or false source-identifying information, including "spoofing" or "phishing";
  • promote or advertise products or services other than your own without appropriate authorization;
  • abuse Orangedox for Dropbox referrals or promotions to get more share links than deserved;
  • abuse the Services in a manner that circumvents share link limits;
  • sell the Services or Services accounts via unauthorized channels;
  • use automated or other means to create accounts in bulk or to access the Services other than by using our official interface;
  • publish or share materials that are unlawfully pornographic or indecent, or that advocate bigotry, religious, racial or ethnic hatred;
  • violate the law in any way including publishing or sharing material that's fraudulent, defamatory, misleading, or that violates the privacy or infringes the rights of others.

Orangedox for Dropbox Security Policy

1. Security The Information We Collect and Store

Preview Document File Storage

We use Amazon's S3 storage, which is encrypted with 256-bit encryption, for all of the document that we provide preview for, this includes PDF files for our premium plans.

Dropbox Access Tokens

All tokens provided by Dropbox for accessing your Dropbox account are encrypted and stored using 256-bit encryption

2. Password Security

Password Storage

Passwords are stored in an encrypted format on our servers

Password Access to Dropbox Share Links

Our password protection will allow you to deliever access to your Dropbox share links using a password. Note that once a password is provided by a user they will have access to an unsecured Dropbox share link that can be accessed with a password. It is your responsibility to remove these auto-created share links from your Dropbox if this possess a problem.
